FAQ about International Protection

The Provincial Directorate of Migration Management in the province of residence is where requests to change your province of residence are made. The Provincial Directorate of Migration Management evaluates the recommendation and notifies the appropriate party of its findings.

For one year following the registration of the international protection application, applicants and holders of international protection status who lack health insurance and financial means are subject to the provisions of the Social Insurance and General Health Insurance Law No. 5510, dated May 31, 2006. There is no need for a one-year time limit for people with special needs and people whom the Ministry determines are qualified to keep their insurance registrations. Within fifteen days of receiving notification of the decision against the application's admissibility and accelerated procedure decisions, the applicant, their attorney, or legal representative may apply with the appropriate administrative court. These appeals must be resolved within fifteen days. The court's decision regarding the request shall be final.

The Presidency oversees the process of resettling foreign nationals who require international protection. For the resettlement process, collaboration with public institutions, international organizations, and non-governmental organizations is possible. If authorized, the governorates or the Presidency will grant permission for travel to a third country.

The applicant, or any individuals with international protection status, may work in Turkey per the provisions of Article 89, Fourth Paragraph, of the Law.

Any foreign national or stateless person may apply on their behalf. Without limiting Article 68, a foreigner's legal representative or attorney is not permitted to apply for international protection. If accompanying family members apply on the same grounds, the applicant may do so on their behalf. The minor family members' consent is not necessary for these situations for applications made on their behalf.

The governorates (Provincial Directorate of Migration Management) must be visited in person to submit an international protection application. Suppose it is determined that the foreign person seeking international protection is an unaccompanied minor. In that case, the process will proceed by contacting the provincial directorates of family, labor, social services, and protection tables.

Within 6 months of the application date, responses to requests for international protection are given. The Provincial Directorate of Migration Management informs the applicant if the decision cannot be made within this time frame, and the decision-making process continues.

Syrian nationals under temporary protection in our country cannot individually apply for international protection as required by Law No. 6458 and its implementing regulations due to the uncertainty in their home countries.

Applications for international protection cannot be submitted through a legal representative or attorney. Applications for international protection must be submitted in person. Law enforcement agencies, other public institutions, and organizations must immediately notify the provincial directorate when requests for international protection applications are made at the border gate or elsewhere in the nation.

There is no deadline for submitting an application for international protection under Law No. 6458. However, foreigners who enter our country legally or illegally must submit an application for international protection to the provincial governorate where they intend to live within a fair amount of time, using the goodwill principle.

After completing the files, the Provincial Directorate of Migration Management notifies the foreigners. Resettlement in a third country is carried out in collaboration with the Presidency of Migration Management and the United Nations High Commissioner for Refugees (UNHCR).

Resettlement transactions are carried out in collaboration with the UN High Commissioner for Refugees and under the coordination of the Presidency of Migration Management. The Provincial Directorate of Migration Management informs foreigners once the files are completed.

Applications for international protection must be delivered in person to the governorates. If requests for applications for international protection are made at the border crossing points, within the nation, or at other public institutions and organizations, these units immediately notify the Provincial Directorate of Migration Management of the situation.
